REINFO: A Legal Solution or an Ongoing Challenge for the Amazon? An Analysis from a Legal Perspective

Abstract

Unfortunately, the Comprehensive Mining Formalization Registry (REINFO) has become a permanent measure, with the resulting impacts on the environment and other rights of citizens living in areas where small-scale and artisanal mining activities take place. This article analyzes REINFO from a legal perspective, aiming to address two objectives: first, to determine the main legal impacts of REINFO's uninterrupted implementation, specifically on fundamental rights; and second, to determine whether expanding REINFO or abolishing it entirely is legally sound. While the violations of fundamental rights, such as the right to a healthy environment, are undeniable, the answer to the second objective—whether the law can intervene abruptly to change such a complex situation within the current complex and unstable context of Peru—is less clear.
